I think that, regardless of the deal you have with the seller, the primary lender that you refinance with may not like you having a 0% equity stake in the property, or very tiny equity position of less than 25%, and may require you to reduce or eliminate the "junior lien" or whatever you want to call it that is this seller carry item.

As it turns out, both the heloc loan officer and the confirming mortgage loan officer said the same thing - since my heloc has a $0 balance, it doesn't count towards DTI calculations!

This often happens when the assessor office creates a separate lot for tax purposes but the larger lot of which it is part was not legally subdivided.Also, as pointed out above, tax liens, weed abatement charges, HOA, etc all usually survive.
