If that's the case, you can pay a quick visit to planning commission department and have them pull up past cases of R1 lot sub-division & how the PC / council voted.

City Council just passed the Expanding Housing Choices initiative on 9/3, and they go up for vote before the County on 9/23.

We’re encouraged by the City Council's stated commitment to creating more housing capacity.

Word on the street is that there is little appetite on the council to actually pass any of these regulations.

As landlords we don’t create a shortage of housing, but we can help provide it if those passing laws don’t impede our ability -and in the process create more shortage.I attended a city counsel last week and spoke personally to 2 council members who had not heard directly from housing providers like us.  

Not sure what the solution is but hoping things turn around before Seattle has the affordability and homeless population of San Francisco plus traffic of LA...its like city councils don't ever look at each other and figure out what not to do.

The legality portion of this can be best answered through your wife's realtor board's legal council I would imagine.
