I would still go ahead and list it for rent early no matter what. 

Your investor friends may have different advice, but no attorney is going to say "Don't worry about it... go ahead and breach the terms of your Deed of Trust."

I've audited  in 2000 something (unrelated to real estate) and the irs guy understands the situation, so they just cut the penalty by half.sometimes we worry too much, as long as it's documented, go ahead!
