So if you're the listing agent it could be a nice little bonus you can offer to the buyer and if you represent the buyer then you'd be hooking them up with a nice closing gift in the form of the warranty.

I'm remind of the old Twilight Zone episode where the lonely guy buys a love potion for cheap, like $10.He was impressed at the exceptional value and it's powerful effect on his love interest, who doted on him and made him the object if her desire round the clock.I don't recall what the antidote cost him, but he gladly paid the old shopkeeper the astronomical price to get 'her' out of his life.Perhaps the note could be "gifted" to a competiting note buyer?

Good news though--FHA allows you to use "gift funds" for a down payment, so your parents, uncles and aunts, etc, could "gift" you money to use in a purchase.

I seriously doubt a judge would remove someone from title simply because they couldn't be served.If there is animosity between the two, then the best bet would be for You to find the girl friend, as a neutral third party, bearing gifts.
