The roommate (without the order against him) loves the place and is consulting the military's attorney.

Many property owners in this financial situation do not know who to trust since they're being told different things by attorneys, the bank, investors, and Realtors.

Some investors, (and some attorneys are comfortable advising)  running without an LLC for some people and instead having an insurance policy in place to cover most likely scenarios of paying.

I see many times the deals get sent to the attorneys to "handle it" but this should be sorted out upfront whether tenant stays or goes.In terms of having the tenant removed, there is no way to have them removed from the legal perspective if they are paying rent and you weren't going to move into the unit.

Talk to an attorney about this issue.

I did speak to a real estate attorney, and his recommendation was just have the property LLCs and operate out of them property wise/independently.   

I recommend you use an attorney to ensure the contract is clean and you are protected.
