I had to scramble and made a bunch of calls before a 24 hour plumber picked up and he said he would be there in an hour.The house was built in 1962, so the original sewage line was probably a clay line and it’s life cycle was coming to an end, as it took the plumber 2 hours just to clean out all the roots that were causing the backup.I didn’t get home until 2AM.The condition of the sewage line was so bad, that I had to get it re-piped for ANOTHER $3000.

So I had to counter all the BS negatives he produced with pictures and documentation to assist the buyer - - 'fait accompli',  appraisal came in just 5k short the the listing price.The inspector was just way off base, opening subpanel covers and complaining on  the wiring - - just cleared by the City :sheeze:   Also made many ridiculous recommendations, including installing drains in all the flower beds.ALL such recommendations can be denied, I did, and I still closed at the listing price.Then too, the inspector & the appraiser both FAILED to cite a recent change in Code (cc 505.1) and it only got caught by the Fire Marshal and I had to scramble to get that corrected.

If it was an employment complaint, lawyers would be scrambling to sign you up under contingency - because the laws spell out the fines, etc., that must be paid to an employee.

Normally, if a tenant breaks a lease, the landlord has to try and find another tenant right away, and can only charge them rent until they find a new tenant.If you write up a separate option contract, that is not a lease, but is a contract regarding you not advertising it to someone else until they either sign or not on October 1st - that you should then be free and clear to just keep that money, without them having the ability to change their mind after a month, and leave you scrambling or having to explain to a court why it took you so long to find another tenant, yatta yatta.And the problem with collecting a security deposit, is you would have to follow security deposit law, so you wouldn't be able to keep it.So, I'm thinking something like this:Tom DiEnna agrees to hold the property at ____________________address vacant until October 1st.
