If it is in yours then likely it is in theirs as well.If it doesn't say in yours then likely it's not in theirs.I can't give legal advice but rather than suffer in silence I would call the landlord and explain you have sensitive lungs and cannot be inhaling in second hand smoke.Second hand smoke is actually MORE DANGEROUS than first hand smoke. The reason is the person smoking the cigarette has a filter before inhaling in and the second hand smoker breathes all the smoke in without a filter.Today's cigarettes are pumped full of chemicals because it is cheaper to make and the burn is faster. The faster the burn the more people will smoke and buy that next pack with a huge mark up.Back in the day smoking was almost all pure tobacco but it is so expensive they use chemicals and very little tobacco today. So in short don't put up with it.

the tenants at one house moved out a few weeks ago. they were there just one year and moved in after the house was freshly painted and re-carpeted.anyway. there were fingerprints and smudges on the walls all over the house and even areas that you'd have to try to leave a fingerprint. nothing that a new coat of paint can't cover, but the whole house needed to be re-painted.regarding the carpet, there are dog pee stains and large furniture impressions. they tried to steam all stains out and even used spray chemicals to remove them. it does not smell, but the stains are there.would you charge them or keep a portion of the s. deposit for something like this?
Greg S. Concerns about rehabbing a flood damaged house?
13 May 2017 | 31 replies
You have no idea what chemicals were in such flooded waters, how they will effect materials even if they appear clean since wood can absorb chemicals and dry out, like petrolium products. While some of this may not be a problem for the seller, it can increase liability issues especially if not disclosed.
