I tell him I'm unhappy with that and he offers to tear it out and redo but at this point, were 12 weeks in and can't afford to wait however much longer it would take to do that.

I bought the property last year without knowing its history, so I attempted to have the tank pumped only to learn the septic company would either have to tear out the driveway over the tank, or charge me $50/foot to dig and hopefully find the clean-out (though it’s not guaranteed they’d find it).

Legal non conforming generally means its use has to be changed per town ordinance IF it needs rehab such as tearing down to the studs, total demo, partial demo, new electrical system etc..
