I have a Holding Fee form along with the application that they must sign to hold the unit and it lets them know it's a fee, not a deposit, and is forfeit if they do not take the unit.

If you throw a SD in your personal checking account, a tenant destroys your place and you need to withhold money from the SD and the tenant calls you out on if you have the SD in a separate account, you could end up forfeiting the SD no matter what damage they did.

BTW, there exist some common law (judges rulings) cases where it is stated that the redemption rights cannot be purchased, forfeited or assigned in PA.Time for you to research the actual PA statutes and rulings - some of your book info isn't as accurate as you might want.

If I find something in their background, i will return the money to them and move on.if they call me up and say they've found a new place 2 weeks later, they forfeit the $200.00 and it's mine to use to re-advertise the space ect.
