The suit was 90 line items long and they are suing everyone involved - 6 parties in all.

Assigning to related/interested parties is fine, but if you market your position in the contract in order to assign it for a fee, that's a no-no. 

Who was the third party company that specialized in investing the 401ks? 

Is worth 3x what I paid for it back then as well as the rental income it generates.The zero cash flow part is concerning though.  

It is allows sourcing deals from anywhere (not just the deals from the party that runs it and who is trying to channel investors into it), and allows people to perform real, collaborative due diligence to poke holes in deals (and isn't just a "rah-rah let's go" for preselected deals), etc.It sounds like you're looking at the first type of group.

I believe there’s a middle ground where both parties are satisfied.  

So, to be sure, the other party would find it very expensive to defend the lawsuit.
