While that is definitely not right, it may be worthwhile to just accept it to get the deal closed. 1% is probably fairly insignificant in the grand scheme of things.It's tough to do, but sometimes you have to ask yourself "Do I want to be right, or do I want to be rich?"

I personally think owning properties in an LLC is important enough to make the added costs worthwhile, for me anyway, and insurance is never a substitute, but again, if you don't have a ton in the way of assets yet, you may have different priorities.
