One thing you might add to your list of "to do's" is create a "Walk Through Form" for the tenant to sign when you give them possession so down the road there are no disagreements over the condition of the property when it is time to disperse their security deposits when they eventually move out.

As @Jon Kessler said, it's best to have the purchase agreement say the property will be vacant when you take possession.

I'm on the fence about contacting a lawyer, just because I don't know if I should be going after the HOA for the work to be completed due to their negligence with the initial inspection that was supposed to be done before possession, or the builder who was supposed to complete the work regardless.
