It was my understanding that hard money lenders awarded money based on the property and not necessarily the person.

Thanks everyone.I have been reading up on Georgia Landlord Tenant Law Code.I found that if you file against a tenant and they do not answer then you can get them evicted but the judge cannot award damages.So would I have to bring a separate action for the damages if they do not answer??

A properly structured business entity may help limit your personal liability exposure if the entity is sued, but the entity does not pay the cost of defending against the lawsuit nor pay the judgment award if a lawsuit is successful.

I'm certainly no attorney, but my guess is that if the property is held as Joint Tenants and there is no divorce decree (or other judgment) awarding ownership of the property to just the wife, then there is no way she can sell it without her husband's permission.Again, that's not legal advice, just a non-expert opinion...
