Once you start changing the rules because you get good or bad vibes from a potential tenant, you can get yourself in serious hot water and end up in court for a fair housing violation. 

Typically a seller can't get out of a purchase contract once they agree to sell, but it's also rare for a court to force a sale if the seller just doesn't show up to closing.

So, I don't know if it is a function of their management or a function of the investors they manage for, but tenants have a negative perception of their properties.

You might talk with a real estate/estate attorney and see if it's possible to open a probate, have a Personal Representative appointed and obtain an order from the court authorizing the sale of the property by the PR with the proceeds being deposited into the registry of the court for later distribution when all the heirs are identified. 

Also - presuming you paid more for the property than was owed on the mortgage due to competition on the auction (several presumptions there) - the previous owners are entitled to those excess funds from the court - which gives them a resource to be able to afford our rental rates. 

I'm really interested in foreclosure/ pre-foreclosure purchases and have been studying on how to read court documents, title searches, and I have been watching the auctions daily.

Did they pay the $100,000 into court when they filed their lawsuit?

It is mortgage fraud, you really don't want to land in court over that.
