If you leave the Rental Unit unoccupied at any time while Rent is due and unpaid, we may, at our option, take immediate possession of and exclude you from the Rental Unit, removing and storing at your expense all property found contained therein.8.

There are 5 touch points.  1 is the initial posting on the door - (some leases will allow tenants to waive their rights to a 10 days notice - for late rents) or a 30 days notice is required on a MTM lease. 2 is the magistrate filing (about $150 to $175 - depends on how much is owed, and how many people on lease or you'll have to write "Et tal" after 1 name to cover the entire household when you don't know exactly who lives there. 3 is going to court - the local magistrate will mail you a date and time to appear.  4 is waiting the 10 days after you won possession.

In the future, always do a final walk-through on the way to closing, and write into the contract a monetary penalty for failing to deliver possession by closing date (I use $250-1,000/day depending on the value of the property).  

Without this top "skill" many people who possess many other needed skills will never start building their dream life due to naysayers around them.2.

If stuff is left in the home we simply trash it out after we have legal possession and get to the business of doing the tenant turn.  

We have language in our leases that it is the tenants responsibility to maintain the landscaping in the same condition it was in when they took possession.

I was granted immediate possession of the property but no lock out until July 31, 2021.

@Thomas Kelly sounds like too small of a spread to me... especially since the investor may need to wait until February (or later) to get possession of the property.   

A key factor for him was having the ability to close on it and delay our possession for a couple months to give his family time to finish school and get ready for the move.

Now FL law states “the landlord shall not recover possession of a dwelling unit except: … When the tenant has abandoned the dwelling unit.
