It does cost almost twice as much as boundary survey but has a lot more detail than a plain boundary agreement.

I mentioned having an airtight agreement drafted up by an attorney.  

However, if you've lost confidence in the brokerage all together then it might be time to ask them to terminate your listing agreement.

Maybe just a stern letter from an attorney will be enough for the sellers to come to an agreement to pay something to you without having to take it further. 

It's important for both parties to fully understand these risks before entering into a second-position loan agreement. 

The seller has no agreement with the end buyer therefore cannot take any action to make them pay.

However, the listing agreement for any property type would dictate if this practice is allowed or not.
