If this is a month to month agreement you can beef up that language now if needed, just give enough notice that you are amending the contract.

Additional notes: IF you make the withdraw there is no 10% penalty The repayment will then be taxably recognized across 3 years (vs all in 1)IF you re contribute it by the end of year 3 you can amend the earlier 2 years returns where you paid taxes and request  a refund of the tax paid.

Withhold the rent, go to court and duke it out, be damned sure your lease is not getting renewed.But the LL may not be stupid about this and acknowledge your legitimate grievance, and make amends, and the relationship may not suffer irreparable harm.
