@Basit Siddiqi is exactly right that Philadelphia / NJ has some unique reporting headaches that are often screwed up, so whoever you work with, gauge their experience working in numerous jurisdictions, or their teams access to those subject matter experts.Those in the construction world and rental world open themselves up to some substantial opportunities from a tax planning perspective, but also need to be sure they thread the needle carefully on the real estate professional rules to actually qualify for them.

Hypothetically, if I took over someones existing mortgage subject to and owned the property cause I have the title now, would I be able to get a home equity line of credit or equity loan on that property if it had a good amount of equity?

Beside the “subject to” that’s recently become the subject of much debate we utilized  ”no interest short term owner financing”, the “2nd mortgage crank”, substitution of collateral, mortgage subordination, wrap loans, real estate “exchange” (not for tax reasons), sale - lease back, guaranteed rent payments, sale - buy back, land offered in lieu of down payment, zero coupon bonds as substitution of collateral, and a few others that escape my memory.

I would NEVER, EVER offer up a reason to a tenant - minimally, you'd be subjecting yourself to an unsolicited argument/negotiation, and could be opening yourself up to a discrimination claim or other such legal entanglements.
