You may want to approach the contractors and let them know you plan on putting in a claim and see if that prompts them to offer a compromise. 

You need to consult with a lawyer.Best to reach a compromise if you can with the buyer.

I also passed on regular 1031 exchanges because you’re either transacting in an up market, where you often settle for lesser properties so you can complete your exchange, or you’re selling in a down market where your initial sale is compromised.

They look out for their clients, both the landlords and the tenants, and we work together to try to save the property owners money whenever and however we can, as long as that doesn't compromise the quality of the services or repairs.

It is a compromise but you need to explain that this is important for you and WHY this is important. 

I'd suggesting taking a proactive step towards a compromise (such as installing a bike rack) that might solve the problem while still accommodating the tenant.

Since tenant selection is the most time consuming and highest risk activity, that may be a compromise to get you started.
