My lease states that the tenants are responsible for the payments as a typical lease would, but should I make amendments since the insurance agency is actually responsible for the rent? 

May I amend this to add a 6th line item please?

Instead I would look at creating an amendment to the current lease the changes the responsible party to the new tenant and the new tenant just takes over the current lease.

If they've been horrible tenants, I would never consider amending the lease-break the lease, have them pay whatever the penalty is and get new tenants.

The CC&R's would need to be amended, and per Section 10.2 of the CC&R's I located, it is nearly impossible to amend the document. 

Today is Nov 10th, and he still did not send me the payment and has not responded.In July, when it was time to renew the lease, he also messed up on the renewal dates on the contract and was reluctant to get it amended with the tenant.

I would just add that we do a full attorney review of LLC docs prior to closing loans and the vast majority still have issues that need to be fixed/amended (albeit this is a short easy process typically).
