The problem was the MLOs and Mortgage Brokers did not know what they were doing to follow that narrow methodology so the whole transaction could have been interpreted as an "ongoing criminal conspiracy" which could have invoked the RICCO statutes.

@Westin Hudnall It occurred to me when I read your response that bimonthly could be interpreted as every other month, I was interpreting it as a rental inspection twice per month, which is obviously ridiculous.

If you were on a week to week basis, you would have to give 7 days notice, and that would end at the end of the rental period of one week.It should be interpreted as at least 30 days notice.

I also completely agree that it’s easier to loan on purchase price for all the reasons you mentioned, plus a few others. 1) Purchase price is a well-established number not subject to the interpretation of comps, as ARV is.

As for choice of state: if your LLC gets sued by a third party, chances are high you'll be in Ohio courts interpreting Ohio law anyway.
