I could detect the smell in the bathroom, but it was not overpowering, and I couldn't detect any cigarette smell in any other part of the house.Confession time was over, I proceeded with inspection.  

Basically your authority as a landlord is shared with a committee of busy bodies. - Another thing about the HOA that is unknown is how well it's finances are in order.

Incidentally;  a substantial part of my anti pet stance is that I ate, hate, HATE the smell of dog and cat poop and pee.

@Scott Szurek, Most states have a governing body that does child care assessments to make sure the property is kosher for running a day care.

Rent in the areas we are interested in is about $1300 – $1550 for a 2 bds/1 ba.We were thinking of a duplex priced at $440k, built in the early 1900s and has funny, damp smell in the basement. 

We gave 30day evictions and no body moved out.
