If you feel that a late fee is some sort of a punishment, then I suppose you will feel righteous in not assessing it.

The nice thing is that the 1031 allows you to do this even imperfectly and still avoid all the tax - so even if there's punishment its usually opportunity cost and not a painful eye gouge. 

What you are suggesting is a punishable offense worthy  of jail time  .

If that's the case, wouldn't there be some punishment or penalty if you advertised a property as having hardwood floors when its really bamboo or laminate?

They have the right to call your loan due immediately if they find out that you aren't occupying, and furthermore you could face other punishments such as fines or jail.Hope that helps, best of luck!

If a law is "tenant-friendly" it means the tenants have enough rights, under the law, to make it very difficult for the landlord to get rid of them or punish them.

Also, Dennis, the way things are in our government, do you think Congress will act, or just continue to punish Obama for getting elected by blocking everything he touches?
