I know that the FBI, IRS, and FDIC tend to move very slowly and deliberately, and only move forward with an arrest when they believe they have a very strong case with sufficient hard evidence to get a conviction. $35M is a lot of money as well.

@Brian Bradley you seem to be deliberately not focusing on  the most important piece of the statistics here: the death rate for swine flue. 17,000 out of 60,000,000 is a very low rate (1/1000 of 1%).
