Listed with Agent Houses with no EquityIf a house is listed with an Agent, and there is no equity based on comps vs mortgage pay off, you can talk directly with the owner.Then either-Wait for the listing to expire or-have the owner talk with the broker of record and get the listing released, in writing.

Just like several other posters stated, she should pay the money into escrow because if you go to court the judge will say pay the rent into escrow and it will be released once repaired or 7 days to move out.

This is of course, assuming, the lender fully releasing the mortgage and seller released from all obligations under the note and mortgage and the lender waive all rights to collect on any deficiency amount.In other words, the only thing that matters to the seller is the terms - the contingencies, is there an inspection?

We've had escrow issues where mortgage wouldn't close without repair escrow, said we needed to produce receipts of repairs to get our funds returned, but then when proof given, the mortgage company wants escrow funds put toward balance on our loan instead of releasing our funds back to us (even though we'd already put 25% down).

I assumed he meant there was a mortgage on both lots, but the foreclosure suit erroneously had the legal description of only one lot.Ahh, if they had a lien on the other parcel they may foreclose if the debt was not paid from the house, otherwise it needs to be released.
