I have a term in my house rules that state if there is a violation of the noise ordinance, I keep the entire deposit and the rest of the stay is forfeited.

Notify them if they back out after that they forfeit those deposits (if local law allows).  

However, I’d also look to the company attorney (Christopher Kunkel) as a co-conspirator and potential co-defendant.

If you missed the deadline, you forfeit your deposit.

Hopefully they paid February and you get it rented soon but I assume under the terms of your contract at the least it says the deposit is forfeited if they break the lease and you may come up ahead.
