I have paid a few agents outside of escrow and if your shortsale leads are good ones, I would pay you out of escrow.If you are looking to market for short sales you may want to put together a direct mail or door knocking campaign on NOD 30-60-90 lists, or there may be a list of people who have applied for a loan modification.

Another issue is making modifications to an installment sale or CFD, that modification constitutes making a new contract, now with the SAFE Act and Dodd-Frank, you're probably in violation if you keep to the basic terms of the old contract with balloon payments and in keeping the secured as originally made.
