@Chai Jonn if you can execute on teh 1031 this is a great time to do it to move up in terms of quality of collateral. 

If you are doing rentals you could build over time, make intelligent acquisitions  and execute a strong strategy; eventually you will have enough doors for that.

If you can sell and acquire a better deal to park your money in, execute, but this is easier said than done.

In my experience a good property is harder to find then the funds to execute the deal.

I have a fully executed version of the lease with both of our signatures, so the basement language is enforceable in my opinion.
