You are literally just swapping properties.

There is the same 2 year holding period, but then we have to address "basis swapping" issues under IRS Revenue Ruling 2002-83. 

This could be something as simple as stating, "The city allows us to swap designations, the ADU we built is now considered the home, the smaller structure is the ADU".

I know you don't need one for a swap, but that is not my case. 

Often they will let you swap out the prepayment penalty for a tad more in points/fees upfront.

As far as swapping cash for the note it really is as easy as that. 

Create a few templates that are reusable and swap out photos and addresses as necessary. 

Time will tell if this proves true but either way, if one goes down, I'll just swap in a cheap, used one.
