This is to say, post-pone the closing until the unit is delivered empty or do it only if you are fine with not getting rent for what may end up being several months. 

I'm really just trying to fine tune everything right now to eliminate as much resistance as possible.

If you are a doing an infill build-to-rent, that's fine, but in the current environment, it is very difficult to make any cashflow so its a 100% appreciation play.

I'm fine with combing the market for deals, just trying to find a way to legally secure financing without a due on sale clause raining on my parade.
