I'm not a lawyer, but I don't think smoking would constitute more than normal wear and tear unless his lease specified no smoking.

With commercial financing it is all smoke and mirrors, then you get a ridiculous contract you cant read, with things hidden everywhere, more importantly your time wasted.

The inspectors are looking for safety things like smoke detectors and GFI's.

When I do the move in, tenants sign a condition statement that includes "smoke detector batteries were replaced on 9/1/12 and all smoke and carbon monoxide detectors were tested and found to be in working order".

Keep it for a while until the smoke clears and realize your profit another day, or just keep it.
