I do not think that this is a requirement, based on the language of 469(h)(5) Section 469(h)(5) doesn't mention this specifically, but ....IRS Pub 925 clarifies this, Spouse's participation.

The layout of the lot would have to be just right (for example a corner lot) and the main house may need to be discounted depending on what's happening there (for example if now there is no garage, part of the backyard was chopped, etc.).

Cash flow - rents in the area are $800-900 based on a search of what's available, current rents are $600-750. with Section 8 @ $800 for a 1/1.
