Which brings me to another question; the agreement states that the homebuyer/occupant will retain home owners insurance on the property and list the lender as loss payee or first lien holder on the insurance for the life of the loan and yes I know it's in the agreement that was signed but I am wondering if by law it's even required once it used to be 20% but now it's 10% of the loan has been paid off, even big traditional mortgage lenders will remove PMI costs after 10% has been paid off.

Pays only 8.5% but is the most conservative note fund we have ever come across as they only do performing notes that are in first lien position and only on homes that have a mortgage under $600 and people have at least 50% equity in their homes already.

Wouldn't the downside of doing any of those things be that if the existing owner gets any liens or judgments, they will still attach to the property?

If they don't pay your judgement you file it as a lien at the courthouse and they won't be able to get a mortgage to buy their home until that judgement is paid because that lien would apply to any house they buy and be in 1st lien position BEFORE the mortgage.
