To wit, Freddie will not go for a 7th financed investment property at all, meaning Fannie is the only game in town, and if there's something about your finances that Freddie would otherwise go for but Freddie would not (f. ex. 1 year of self employment tax returns), that means this would be a deal breaker.

I don't think that this clause is necessarily a deal-breaker (and I could be totally wrong), but I'm taking on a hefty amount of risk in the case where I assign the contract to another investor without my own non-refundable earnest money deposit.

Not having a pool isn't a deal breaker for most tenants and if you do rent a property with a pool, you have to either rely on the tenant to do basic maintenance (dip out leaves, empty skimmer, brush down steps, fill it occasionally) or hire a pool company to do service - and that ain't cheap.
