There are occasions when something is done to fix a problem, but either creates a new problem, or did not actually solve the original problem.If any new work is required, you may think about finding your own contractor to do it, or let the PM know that you will be paying the contractor directly.

Agreed on this point, especially considering that suing a seller who has an exclusive listing agreement and who tries to avoid paying commission is a VERY easy lawsuit to win.From those I've spoken with who have had to do this on multiple occasions (I've never done it myself), it basically boils down to the judge asking two questions:1.
