For example, there could be verbal agreements made outside of the lease agreement (or at least allegations that there were verbal agreements made), and an estoppel agreement would confirm whether or not that's true.

I think that there are two camps trying to make this change.The PC camp is trying to make the change because the word is allegedly gendered (even though landlady is available, landnonbinary and landgenderqueer are not yet popularized).

If smoking was not prohibited, the burden for offsetting will be greater and require more documentation (after 8 years residing there, the allegation that the paint was damaged from the smoke - versus time - will be difficult to prove).
