If other businesses have contaminents that have leaked into your soil that could be a huge development problem.You might want a developer consultant who knows that market to discuss further.I know nothing of Washington.

Here in Kansas City it's actually been really dry (in spite of the winter snows) so a lot of the problems are from the soil drying out and shrinking from the foundation, removing the support from the sides and bottom.

If there is any liability it's minimal, as they are inspecting and not certifying the property.There could be natural springs and if so I can understand why the buyers would back out.You might need a soil scientist to look at it and if he/she agrees with the inspector than see what the solution is.
