Didn't pay so the Unlawful Detainer was filed and then he went to the courts 4 days later and filed an unlimited civil suit against me for habitability, etc.

Last thursday my landlord attempted to unlawfully evict me and had another person help him remove my things from my lock room- ( i rent a room and am under contract/ lease for the room)  He never gave me an eviction notice in writing and rent was late due to my disability check being late but he never incquired about when or if i was going to be able to pay rent.

I was not willing to wait for them to move on their own schedule and send them a 5-day notice to vacate the premises, filing immediately for unlawful detainer.

Fraud: a deception deliberately practiced in order to secure unfair or unlawful gain (adjectival form fraudulent; to defraud is the verb).And it totally undermines the idea behind the rule, which is to offer an opportunity to get into property to folks who don't have an extra 10k or so to throw down.

If either of the notices expired, and he is still there, you can start the Unlawful Detainer law suite to evict him at which time you need to summon him to the court and go through the entire process.
