One thing I can say is if it does not feel right, it might be better forfeiting the escrow than taking on a money pit. 

If they fail to comply, the holding deposit is forfeited.

I do not have such a clause in my leases, but from what you are saying it sounds like tenants will risk it anyway and just forfeit their deposit.

Terminating the deal will cause you to forfeit your earnest money, not to mention waste everyone's time.

I would use the 95k to reinvest into another property just dont have one in mind yet.is it worth forfeiting a 3.25% interest rate for only 95k that I could get in 4 years of rental profits?

Hi Michael, if one bank/ mortgage company does a refinance shortly after they do the loan on your first property, they have to forfeit the commission on the first loan.
