I can't imagine any circumstance a borrower would go along with this plan if you tell them the truth that you don't plan to pay the mortgage.

If you cause the damage of someone reputation, thereby causing them to suffer any kind of hardship, yes, you can be sued, but as long as your statements can be proven truthful, then you are not liable for the damage your statements have caused.
