I asked this very question to former head legal counsel of well-known title company here in CA.His answer: “It depends.”That was helpful.As the prior poster indicated, each of these cases are unique and have their own facts and circumstances.

But, to be honest, we see this a lot with newer REIs.Did you account for the CapEx timelines for each rental prior to purchasing?

Your current mortgage payment will not affect DTI as long as you have a future tenant lined up prior to closing on your new primary. 

Don't listen to proforma numbers on things that the prior owner couldn't do and you shouldn't pay the seller for your future efforts and hard work. 

You will be surprised how often that will get you more information...often critical information.Second, if at all possible, try to get on the phone with the landlord prior to the current landlord.

I am sure maybe they only went up a little bit prior to the crazy price increases.  

We prefer to handle this because tenants often don’t find high-quality replacements on their own.In our market, we usually need a 30-60 day notice prior to move-out to fill the unit.

And that by itself could blow up your exchange.The cost for a QI like us to do your 1031 exchange is very small - especially considering al of the other issues you have going with this sale.The QI does have to be in place prior to the sale of the old property.  1.
