Based on what you write below, I think you are misunderstanding what a "contingency" is...A contingency is something you put in your contract that gives you an "out" if you need it.

Another thing, when I called to get a copy of the 1098 and 1099C (haven't received it yet), the lady acknowledged there was a 1099C, so I'm a little confused as to how you can issue a 1099C and then also attempt to sue for the balance.I don't think they can so hopefully it is a big misunderstanding.

He sent us an email back , saying sorry for the misunderstanding and a new addendum to sign adding the words"paying $80 a month for landscaping in compliance to 11c (which refers back to the maintenance contract)Now the agent only quotes the first addendum ...god knows what happened to the second.We never did receive a copy of the lease just after moving in.But if the landlords use that in court...and the court dismisses the emails and/or the changes that was made with the addendum (no proff of signing)....am I actually responsible for landscaping, shrubs lawn etc?...

You could have ground contamination problems, the disclosure issue when you sell, etc.Sorry for misunderstanding the 203k thing.
