If your market and listing allows for automatic escalating offers ($250 above best price of highest other offers, up to X) then you can get around this and the clause is written such that they have to show you the other offers once your offer is accepted by them.

The time thing is mostly just my hours, I work 3rd shift 10 PM to 6 AM and have weekends off so my hours awake are very odd and depend on the day as I do tend to work overtime a lot.

Recommend you just Google "commercial lease" and copy & paste to get what you want covered.If you want commercial tenant to be responsible for the building, that's known as a Triple Net Lease (also shifts taxes & insurance liability).Then you should have a real estate attorney go over and approve your copy & paste creation.

Will your partner be upset because you are getting the better end of the deal living rent free(assuming you aren't paying rent).What if only your name is on the mortgage and deed, then the tax documents will all fall on you and your tax return and not his which makes it more complicated trying to shift income to him.If there are two people on the mortgage, it will impact both your DTI ratio's equally in full hurting both of your abilities to get credit in the future until the property is sold.Why can't you do the live in flip on your own?

Sure it is a 6 Family that was built in 1935 which automatically pulls it into the rent stabilization program.
