Either this warranty deed is held in escrow where it will be destroyed upon payment in full of the note or recorded if the loan is in default; or the warranty deed is recorded and will be rescinded if and when the note is paid off or at some mutually agreeable milestone is reached.

Not a fan of loan guarantor fees in general.Sponsors track record in these types deals across multiple economic cycles (when I see these types of deals, I mean acquiring new construction multifamily in the area)I am sure if I saw the deck, I would have at least a dozen more questions.

Instead I would just need to do the title search first, then once I pay the down payment file a memorandum for the amount I paid them, and then record the purchase and sale contract/land contract with the county so it's on record and clouds the title for extra protection.

I am a little shell shock from 1980s and older since things just break like my old 96' Honda Accord.Track Record & Past Performance:Evaluate the operator's past deals using third-party reports (e.g., CoStar, Yardi) - these cost 10-20k a year and again this is not in scope or access of LPs.Verify past performance metrics (walk past assets and secret shop their staff at assets) rather than relying solely on marketing materials.Visit comparable properties physically to validate rent assumptions.
