That is a self help eviction and is prohibited.Your clients could face paying fines and penalties and in some cases jail time for doing such things.If you have the written agreement that the tenant signed stating they would vacate you simply show that in the court proceedings to the judge or mediator.

The proceeds cannot come to you, but must pass through to a 1031 mediator.

Liability & Licensing – Confirm in the written agreement that the independent contractor has liability insurance and is fully licensed by the state and any other relevant regulatory agencies.Dispute Resolution – You may choose to include a clause requiring disputes to be settled via mediation.

Borrower has now requested mediation.

This may vary by county as well since some counties require mandatory mediation for residential foreclosures. 

Trading and negotiating / mediation is not an option as I have asked for a modest reimbursement of some of the money I put into the business and a deadline to refinancing.

Finally, we served the 3-day pay or quit on July 8, 2019, went to mediation Aug 20, 2019, trial Aug 22, 2019.Despite the contract clearly stating that Bridgehouse would pay us rent regardless of whether tenant pays them, Bridgehouse taking care of all damages to property....we have not received any money from Bridgehouse.
