I have a notarized POA signed by the sellers at closing, but I was told by my escrow agent that there is nothing I can do to get that check.

I simply asked them what process do I need so I can get title insurance... the person in possession would not come to title to sign.. so the only thing I could get was this assignment ( which I had a mobile notary show up so we had a notarized sig) ..

If you're completely comfortable with them, email them the lease and have them get a notarized signature on the lease.

My understanding is the estoppel is a notarized document verifying the information is correct (we don't call estoppel in Canada). 

ALWAYS, let me repeat - ALWAYS, require a notarized waiver from every sub before you put a check in their hands.

Offer him $200 to be gone within 72 hours… Stated clearly that he Hass to have everything removed and be out of the house and sign a notarized statement surrendering his rights to the property.

So, even if the contract doesn't bind the investor from adhering to the restriction, the affidavit does.Btw, in my experience, this is not imposed as a deed restriction...just a notarized affidavit at closing.
