If this property was purchased in your personal name (and this may be the case as you lived there prior to getting married it sounds like maybe) you can either set up an LLC and transfer the title to the LLC or you should probably be able to obtain an umbrella insurance policy that would cover in case of lawsuit.

My CPA suggested it would be better to keep it as it is and should be fine renting it out with my mom and my name on it and just getting umbrella insurance.

Seed money is not the same, because, as Cameron was saying, that money doesn't show up on tax returns.I don't personally have an LLC and hold all of my investment real estate in my own name with insurance and an umbrella policy, but there are some benefits to an LLC that make it appealing.

Currently our umbrella policy does not have the option of adding sewer line insurance which we had purchased on several properties when we started out.
