If your initial lawsuit simply asks for the eviction order (you can amend later and ask for damages) then all you need is what is called "nail and mail" service.

I HAVE seen agents issue a "rental" policy on a rehab project but consider yourself lucky your agent advised you against it as that policy would not be worth the paper it is written on in the event of a claim.There are a very limited number of companies out there that will structure your deal in a way that you can simply switch or amend coverage based on what stage of renovation and occupancy your property/project is in.

Hold him to original contract but amend it to state that if he wants more money, he must present receipts and actual labor costs when job is complete and you will pay for additional concrete and labor for 12" x 48".
