I got pulled in front of one a couple of years ago and the judge made it plain that if I continued "brokering without a license" (I called it 'wholesaling' but he didn't care) he was going to bring me in front of the real estate commission (who I thought could only regulate licensees).

The homeowner opted "out" of everything and in my state if your negotiator isn't an agent, broker, lawyer or licensee of some sort, you HAVE to provide a cancelation contract to the homeowner.
