Most often I am essentially doing a short sale on the property negotiating with the primary lien holder and telling all of the juniors that the owner is getting ready to be in foreclosure and they can either take pennies on the dollar from me or get nothing on the foreclosure date due to the fact that the property is already worth less than the 1st mortgage.From time to time I run into ones that have boatloads of liens on the property but it is completely paid off so no mortgage.

But last month I was out-bid on a house by an attorney who was not the foreclosing attorney for that house's lender (and there were no other liens where there was a need to bid to protect the collateral for those junior liens); the attorney was buying an investment.

They can stop a short sale on the first if they demand too much - the first lien holder will not want anything with a junior lien to make out too well.

I prefer to go after the ones where the 1st is foreclosing and there are juniors waiting to be wiped.Now, if it is a 2nd that I have a relationship with...I might offer to buy the note off them, or short them if I have the owner on board.Sorry again about the confusion.
